Equation of Absolute Success

Over the last few weeks I have blogged about the defining quality of Podcasts (context is king) and the concept for a Powered by Passion community.  How fitting that the two have come together over the last few days to create yet another concept.

On October 12th, I blogged about a comment Larry Lawfer had made (”from passion to purpose”) during a PodCamp interview and I elaborated on how it was missing the mark on passion by equating purpose with money.  Purpose can be anything the individual values - that was the missing piece of the interview.  Here we have a great example of content in a particular context, and content missing context.  See… it’s all about context!

Larry and I have corresponded about passion, purpose and money and how you can have all three, or any combination thereof.  One of the greatest quotes of our discussion was how Larry explained what I will now call the Equation of Absolute Success.

“Passion is key to any success.  Purpose is also necessary.  Passion without purpose leads nowhere.  Purpose without passion is also a slow death.  Mixing passion with your purpose is what drives all great successes.”

| success | = purpose * passion

So, how does this relate to Powered by Passion?  Powered by Passion acknowledges one of the above groupings and does so because other groupings are already represented with tangible identifiers.

The Canary in a Coalmine Effect

Radio stations that use Podcasting as a way to build a bigger audience and make it more convenient for their listeners to consume previously broadcasted content have a great measuring tool at their disposal. If the on-air content can’t keep a Podcast audience engaged, get out of the coalmine.

Powered by Passion

This morning I listened to a PodCamp interview of my friend Larry Lawfer.  During the interview, which focussed on becoming a Podcast consultant, Larry made the comment “from passion to purpose” and then went on to equate “purpose” with making money.  I was a bit surprised by his comments.  Is passion not a purpose?  I relistened to the interview and it really came across that it was one or the other.

Coincidentally, Andrea (Just One More Book) phoned me within minutes about an idea she had in response to a post by Bob Goyetche.  The idea is called Powered by Passion and it means that a “member” project has never collected financial compensation of any sort, nor does it have any plans to do so.  These projects can proudly display a Powered by Passion badge (on their website, business card, literature, etc…) which tells others that the motives are rooted in passion.

It’s a brilliant idea and I’ve already started to work on it.  The vision statement is being written, a website is being prepared and graphics are being designed.  Watch here for more information about the big launch - which should happen in the next few days.

A plain brown box arrived at my house today. It was my iPod. A replacement to be exact.  Hat’s off to Apple for being quick with a solution.

I’ll be back into regular Podcast listening mode tomorrow. I hope I haven’t missed much.

My Micro Manifesto

A few weeks ago, Chris Brogan published his Micro Manifesto — his “small document of guidance”.  Canadian Thanksgiving had me thinking a bit more about his idea.  So, with the blessings of Chris, I have created my own manifesto, borrowing only a little of his.

Understanding Tariff No. 22

I’ve been in contact with lawyer Andy Kaplan-Myrth in order to learn more about SOCAN’s Tariff No. 22. He explained what Podcasters should know about this tariff and his comments are summarized below. Note that this post is a plain-english summary of what the tariff says, not legal advice.

Andy started off by providing some background on the tariff and its origins.

Back in 1996, The Society of Composer, Authors and Music Publishers of Canada (SOCAN) asked the Copyright Board of Canada to approve their Tariff 22, which would have compensated their members by charging Internet service providers for the music that crossed the providers’ networks. The Copyright Board denied the request because ISPs simply provide the means of communication and are not liable for the information that crosses their networks.

Federal Court agreed, except with respect to caches — the Copyright Board had found that caches were necessary for Internet transmission and therefore not liable for the tariff; Federal Court disagreed and tariffed caches.

In 2004, The Supreme Court of Canada threw out SOCAN’s case, including the cache issue, finding that the ISPs’ services are simply a means of telecommunication — not subject to a tariff.

SOCAN is trying again. This time the organization is going after the sites that post the content, rather than the intermediary ISPs. They have redrafted their Tariff 22 proposal and submitted it for 2006, and have now modified it for 2007. They are still waiting for the hearing which will be (mark it in your calendar!) April 17, 2007 at 10:00am.

Now that you have the background, here are the key points of the current draft:

  • Tariff No. 22 applies only to songs for which SOCAN has licensing rights.
  • SOCAN licenses performances only. So, this tariff only covers one piece of the puzzle. SODRAC and CMRRA license reproductions. These organizations have a proposal for licensing reproductions, which may only apply to commercial radio stations (including their Internet-based broadcasts).
  • The SOCAN fees are based on a formula. Since most Podcasters make no money for their Podcasting activities, the SOCAN fees will be the minimum, $200/month.
  • While it is always possible that SOCAN will want the fees to be applied retroactively to 1995, it is far more likely that this is not the case. Certainly, trying to identify and collect licensing fees from that far back will be an ominous task.

In the same way that Apple strong-arming the word “Pod” may move people away from using the word Podcast, perhaps Tariff No. 22 will encourage broadcasters to use more independent or Creative Commons licensed works for which they won’t be required to pay tariffs.
